Terms of Service

These Terms of Service ("Terms") govern your access to and use of Absentie ("Absentie", "we", "us", or "our"). By using the service, you agree to these Terms. If you use Absentie on behalf of an organization, you represent that you are authorized to do so.

1. The Service

Absentie is a proof-of-presence application that allows users to create attendance records containing information such as a captured photo, location, time, and description. Users may keep eligible records locally, export them, or share them with participating teams.

2. Accounts

Certain local features may be available without an account. An account is required for features such as joining or managing teams and server-based services.

You are responsible for maintaining access to your authentication method and for activity performed through your account. You must provide accurate information where the service requires it.

3. Attendance Records

You are responsible for the accuracy and appropriateness of descriptions and other information you submit. Attendance records are intended to represent an actual proof-of-presence event created through the application.

Once an attendance record is saved, its core attendance information may be immutable. Absentie may restrict editing, replacement, or deletion of certain records to preserve record integrity or delivery obligations.

4. Prohibited Conduct

You may not misuse Absentie, including by attempting to:

• Falsify or manipulate attendance, location, time, photos, verification information, or security signals.
• Bypass mock-location, integrity, liveness, authentication, quota, or other security controls.
• Access another user's or team's information without authorization.
• Interfere with, probe, overload, reverse engineer where prohibited by law, or disrupt the service or its infrastructure.
• Use Absentie for unlawful, fraudulent, abusive, or harmful purposes.

5. Teams, Members, and Administrators

A team owner may invite users to a team subject to available paid seats. A user must accept the invitation and applicable data-sharing consent before becoming a participating member.

Users may belong to more than one team. A team may appoint an administrator with permissions made available by Absentie. Certain owner-only functions, including billing and integration configuration, may be restricted from administrators.

A member may leave a team. The team owner cannot prevent a member from leaving. Attendance previously shared with the team may remain available in historical reports according to applicable retention rules.

6. Seats and Paid Features

Paid team features may be priced according to attendance seats and optional add-ons. A team owner does not consume an attendance seat solely by owning a team. If an owner chooses to participate as a member whose attendance is collected by a team, that participation may consume a paid seat.

The current price, billing interval, taxes, and applicable charges will be presented at purchase. Changes to seats or paid items may result in prorated charges or adjustments as disclosed during the billing flow.

7. Subscriptions, Grace Period, and Inactive Service

Paid services are provided according to the applicable billing cycle. If payment or renewal fails or a subscription otherwise becomes inactive, Absentie may provide a limited grace period before restricting access.

Product-specific notices may describe the current grace, restricted-access, and deletion schedule. Unless otherwise stated in the applicable subscription interface, users should not rely on Absentie as permanent archival storage and should export records they are required to retain independently.

8. Webhook Add-ons

Optional webhook functionality may allow attendance events to be delivered to endpoints configured by a team owner. You are responsible for the security, availability, legality, and data handling of endpoints you configure.

Webhook delivery may fail, be retried, or be delayed. Absentie does not guarantee uninterrupted or exactly-once delivery unless expressly stated otherwise in a separate service agreement.

9. Local Storage and Export

The free local application may enforce a maximum number of locally stored attendance records. Deleting eligible local records may restore available local capacity.

Absentie may allow records to be exported as CSV or ZIP files. Export is not a backup-and-restore feature. Absentie does not support importing exported attendance records back into the application unless a future feature expressly states otherwise.

10. Availability and Changes

We may modify, add, remove, suspend, or discontinue features as the service evolves. We aim to provide a reliable service but do not guarantee that Absentie will always be available, uninterrupted, or error-free.

11. Third-Party Services

Absentie may interact with third-party services such as authentication providers, payment processors, map providers, email providers, operating-system sharing features, and user-configured webhook endpoints. Your use of those services may also be governed by their own terms and privacy policies.

12. Intellectual Property

Absentie, including its branding, software, design, and original service content, is owned by us or our licensors and is protected by applicable intellectual-property laws. These Terms grant you a limited right to use the service for its intended purpose and do not transfer ownership of the service to you.

You retain rights you have in content you submit. You grant us the rights reasonably necessary to host, process, transmit, display, and otherwise handle that content to provide the service and features you request.

13. Disclaimer

Absentie provides technical evidence and record-keeping tools. GPS accuracy, device sensors, network conditions, third-party services, and security mechanisms have technical limitations. Absentie does not guarantee that any attendance record is impossible to falsify or that a particular record will satisfy every legal, employment, regulatory, evidentiary, or organizational requirement.

14. Limitation of Liability

To the maximum extent permitted by applicable law, Absentie and its operators will not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, business opportunities, or goodwill arising from use of or inability to use the service.

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited.

15. Termination

You may stop using Absentie at any time. We may suspend or terminate access when reasonably necessary for security, fraud prevention, non-payment, material violation of these Terms, legal compliance, or protection of users and the service.

16. Governing Law

These Terms will be governed by the laws applicable to the operator of Absentie, subject to any mandatory consumer protections or other rights that apply in your jurisdiction.

17. Changes to These Terms

We may update these Terms as the service changes. Updated Terms will be published with a revised effective date. Where required, we will provide additional notice or request renewed acceptance.
